1. Definitions

  • Customer – any natural or legal person accessing the website www.marcopolo.re, placing an order, and/or using the offered products.
  • Product – eSIM (digital mobile data SIM card) delivered electronically via email.
  • Order – the request submitted by the Customer through the website for the purpose of purchasing one or more digital products.
  • Contract – the distance agreement concluded between the Seller and the Customer at the moment the order is confirmed by the Seller.

2. Object of the Contract

The object of the contract is the provision of digital eSIMs that allow access to mobile data services in the European Union, according to the specifications on the product page.

3. Website Registration

  • The Customer can place orders without an account or by creating a user account.
  • The Customer is responsible for the accuracy of the information provided (email, name, phone number), as the delivery of the eSIM is carried out exclusively digitally, via email.

4. Prices and Payments

  • All prices displayed on the website are expressed in EUR (€) and include VAT.
  • Payment is made online by card through the secure payment processor.
  • The order is considered confirmed once the payment has been successfully processed.

5. Delivery

  • The products (eSIMs) are delivered exclusively in digital format, to the email address specified in the order.
  • Delivery time is typically up to 5 minutes from payment confirmation; however, delays may occur due to technical reasons beyond the Seller’s control.

6. Right of Withdrawal

  • Pursuant to Emergency Ordinance (OUG) 34/2014, the 14-day right of withdrawal does not apply to instantly delivered digital products whose provision has begun with the consumer’s express consent.
  • By completing the order, the Customer accepts the loss of the right of withdrawal once the eSIM has been activated.

7. Warranty and Support

  • In the event that the eSIM does not function as described, the Customer must contact our support team at marcopoloesim@gmail.com within 48 hours of receiving the product.
  • The Seller will investigate the issue and, if an error is confirmed, will offer a replacement or a partial/full refund, as appropriate.

8. User Responsibility

The Customer is responsible for the correct installation and use of the eSIM in accordance with the instructions received.

The Seller is not responsible for:

  • incompatible devices,
  • usage outside covered countries,
  • accidental deletion of the QR code,
  • issues caused by local mobile operators.

9. Limitation of Liability

The Seller does not guarantee the uninterrupted operation of the website and shall not be held liable for losses caused by technical errors, temporary outages, or external factors (mobile networks, internet service providers, etc.).

10. Intellectual Property

Copying, modifying, or using the content without the written permission of the owner is strictly prohibited.

11. Processing of Personal Data

Customer data is collected and processed in accordance with the Privacy Policy available on the website.

12. Dispute Resolution

  • Any disagreement shall be resolved amicably wherever possible.
  • Customers may also use the European ODR platform for online dispute resolution.
